Aethrovia for garages

Terms of Service

Version 2026-10-08

1. The agreement

1.1 These Terms of Service (“Terms”) are an agreement between Aethrovia, Arch. Makariou III 24, 4000 Mesa Geitonia, Limassol, Cyprus (“Aethrovia”, “we”, “us”), and the business that subscribes to its service (“the Garage”, “you”).

1.2 The agreement is made up of: (a) these Terms; (b) the data processing agreement accepted in the app (“the DPA”); and (c) any price or other terms we agree with the Garage in writing, including by email (“an Order”). If they conflict, an Order applies over these Terms for what it covers, and the DPA applies over both for the processing of personal data.

1.3 Someone who can bind the Garage accepts these Terms and the DPA in the app (Settings → Terms and data processing agreement) before the Garage uses the board, customer check-in or customer messages. By accepting, they confirm that they have that authority. We keep a record of each acceptance: who accepted, when, for which business, and which versions. If either document changes, the Garage must accept the current versions before those features resume. Settings, data export and privacy-request handling remain available.

1.4 The Service is for businesses only. You confirm that you are using it for your business, and not as a consumer.

2. Definitions

3. The Service

3.1 The Service lets the Garage check Customers' cars in by QR code and form, or by hand; follow them on a board; and send Customers SMS about their car: a check-in confirmation, that the car is ready, that it was picked up and, only to Customers who agree to them, a review request and service or MOT reminders. It also includes the Garage's public page, its history and statistics, and a download of its data.

3.2 We may change and improve the Service. We will not remove checking in, the board or the car-ready message without at least 30 days' notice. If a change materially reduces the Service, you may cancel before it takes effect, and we will refund any fees paid for the period after cancellation.

3.3 We aim to keep the Service available and working, but we do not promise that it will be uninterrupted or error-free. We may interrupt it for maintenance, updates or security, and will try to do planned work outside business hours in Cyprus. Keep a way to reach your Customers without the Service, such as by phone.

3.4 Messages are delivered by an SMS provider and the mobile networks, which we do not control. We do not guarantee that a message is delivered, or delivered at a particular time; delivery reports are for information only. Numbers outside Cyprus may show a different sender name. Review requests and reminders are sent only during the day, Cyprus time. Do not rely on the Service for anything urgent or safety-critical.

3.5 Support is by email at [email protected]. Our usual support hours are 09:00–17:00 on business days, Cyprus time. We aim to acknowledge requests within two business days and prioritise loss of access, failed customer messages and security incidents. This is a response target, not a guaranteed resolution time or a 24-hour support service. Report a suspected security incident immediately, with “Security incident” in the subject. Our staff see Customer Data only as the DPA allows, for example while the Garage has turned on support access in Settings.

3.6 We may give the Garage a check-in stand with a QR code, free of charge. The Garage keeps it. The QR code leads to the Garage's check-in form through our web address and works only while the Garage subscribes. Use it only to direct Customers to that form.

3.7 We may use subcontractors to provide the Service. Those that process personal data are listed in the DPA, and we remain responsible for them as the DPA says.

4. Accounts and security

4.1 Each User needs their own login, and logins must not be shared. The Garage decides who gets a login, and removes a User's access promptly when they no longer need it (Settings → Team).

4.2 The Garage is responsible for everything done with its Users' logins, unless it was caused by our breach of the agreement.

4.3 Keep passwords secret, and tell us at once at [email protected] if you suspect that a login has been misused. We may require a new password, or suspend a login, to protect the Service, the Garage or its Customers.

4.4 Keep your business details, opening hours, closures, links and contact details accurate and up to date. The Service uses them in messages to Customers, for example for the pick-up time.

5. Your Customers

5.1 The Garage is the controller of Customer Data, and we are its processor. The Garage is responsible for complying with data-protection law (the GDPR and Cyprus Law 125(I)/2018) and with the law on electronic communications (Cyprus Law 112(I)/2004) in its use of the Service.

5.2 Only check a Customer in by hand if the Customer has agreed to receive messages about their car, and enter their mobile number correctly. The Garage is responsible for messages sent to a number it entered.

5.3 Respect Customers' separate choices for review requests and service/MOT reminders. Only enable each purpose if the Customer asks for it. Never restore a withdrawn choice unless the Customer asks. Every optional SMS includes a preferences link.

5.4 As controller, the Garage deals with Customers' requests about their data. The Service lets it download, correct and delete a Customer's data, and we help as the DPA says.

5.5 Enter only what the job needs. Do not enter, in notes or any other free-text field: health data or other special categories of personal data; identity card or passport numbers; payment card details; or passwords.

5.6 Follow the rules of Google and of any other review site. Do not offer anything in return for a review, do not write or buy reviews, and do not ask only the Customers you expect to be happy. The Service sends a review request to every Customer who agreed to receive one.

5.7 You confirm that the Garage is entitled to use the business name, SMS sender name, links and other details it gives us, and that they do not infringe anyone's rights or mislead Customers.

5.8 Our privacy notice, linked from the check-in form, explains the Service's processing to Customers. The Garage remains responsible for informing its Customers as their controller, including about anything it does with their data outside the Service.

6. Acceptable use

6.1 A subscription covers one Location. Each other Location needs its own subscription.

6.2 You must not, and must not allow anyone to:

  1. use the Service for anyone other than the Garage's own Customers at that Location, or for any purpose other than the Garage's vehicle services;
  2. use the Service to send, or try to send, marketing or any message other than those the Service is designed to send;
  3. enter anything unlawful, defamatory, abusive or infringing;
  4. access, or try to access, another garage's data or any part of the Service not meant for you; test, scan or probe the Service for vulnerabilities without our written permission; or get around its security or its limits, such as those on check-in codes;
  5. interfere with, disrupt or overload the Service, or use bots, scrapers or other automated means, except through features we provide for that purpose;
  6. copy, modify, translate, reverse-engineer or decompile the Service, except as the law expressly allows;
  7. resell, sublicense, rent or lend the Service, or use it to build or support a competing product; or
  8. use the Service in breach of any law or of anyone's rights.

6.3 We may remove or hide Garage Content that we reasonably believe breaks the law or these Terms, and will tell the Garage when we do.

7. Trial, fees and payment

7.1 Each new Garage may try the Service free of charge for 30 days from when its account is created, unless an Order says otherwise. There is one trial per business. We may end a trial early if the Service is misused.

7.2 After the trial, the subscription fee is €22 a month for each Location, unless an Order sets a different price. It is paid monthly in advance, and the subscription renews every month until it is cancelled.

7.3 The fee includes the SMS that the Service sends for the ordinary business of one Location (fair use). If a Location's messages consistently exceed 1,500 SMS parts a month, averaged over three consecutive months, we may propose a higher price with at least 30 days' notice; you may cancel instead before it applies.

7.4 The Garage pays by card through our payment provider, Stripe, or by bank transfer, standing order or another method we agree in writing. Each party bears its own bank's charges.

7.5 Prices are in euros and exclude VAT. We are not registered for VAT, so none is charged at present. If we become registered, VAT at the applicable rate is added to the fees from then on, and we will tell the Garage before the first invoice that includes it.

7.6 A price in an Order stays as the Order says. If the Order does not say for how long, the price applies while the Garage's subscription continues without a break, and not to another business or Location. Sections 7.3 (fair use) and 7.5 (VAT) apply to every price.

7.7 We may change the standard price with at least 30 days' notice, by email or in the app. The new price applies from the first monthly period that starts after the notice period. If you do not agree, you may cancel before it applies.

7.8 If a payment is late, we will tell the Garage. If it is more than 21 days late, we may pause all messages to Customers, and online check-in, until it is paid; the board keeps working. If it is more than 60 days late, we may end the agreement under section 11.4. The same applies when a trial has ended without a subscription being paid for: we may pause messages 14 days after the trial ends, and end the agreement 30 days after it ends. Late payments bear interest and recovery costs as the law on late payment in commercial transactions allows.

7.9 Fees are not refundable, including for part months, except where these Terms say otherwise or the law requires.

7.10 If you think a charge is wrong, tell us before disputing it with your bank or card issuer. We will look into it promptly and correct any error.

8. Data

8.1 The DPA sets out how we process Customer Data for the Garage, and applies over these Terms on that subject.

8.2 The Garage owns its Garage Content and its Customer Data. It allows us to host, copy, process, transmit and display them only as needed to provide, secure and support the Service, and as the DPA allows.

8.3 For Users' logins and the Garage's billing details, we are the controller, as described in our privacy notice.

8.4 We may use information about how the Service is used that identifies no Customer or User, such as the number of messages sent, to run, secure and improve the Service, and to produce statistics that identify no garage.

8.5 The Garage can download all its data at any time (Settings → Your data). We back the Service up every night, encrypted, and keep the backups for 30 days.

9. Intellectual property

9.1 We and our licensors own the Service, including its software, design and message texts, and the Aethrovia name and logo. The Garage has the right to use the Service for its own business while it subscribes, on these Terms, and no other right in it.

9.2 If you send us ideas or feedback, we may use them freely, without any obligation to you.

9.3 We will name the Garage as a customer, or use its name or logo in our marketing, only with its permission. You may tell anyone that you use Aethrovia.

10. Confidentiality

10.1 Each party keeps confidential the other's non-public information that it receives under the agreement, and uses it only for the agreement. This does not apply to information that is or becomes public through no fault of the receiving party, that it already had or develops independently, or that it must disclose by law or to a regulator (telling the other party first, where the law allows).

10.2 This section continues for three years after the agreement ends. Customer Data is protected by the DPA for as long as we hold it.

11. Ending the agreement

11.1 The agreement starts when the Garage first accepts these Terms or uses the Service, whichever is first, and continues month by month until it ends as set out below.

11.2 You may cancel at any time, through the payment portal we give you or by email to [email protected]. The Service continues until the end of the trial or of the month already paid for, and then ends; there are no further charges.

11.3 We may end the agreement for any reason with at least 30 days' notice, and will refund any fees paid for the period after it ends.

11.4 We may suspend the Service, or end the agreement with immediate effect, by notice if: (a) you materially breach the agreement and, where the breach can be put right, do not put it right within 14 days of our notice; (b) you breach section 5 or 6 in a way that risks harm to Customers, the Service or us; (c) a payment is late as section 7.8 describes; (d) the Garage becomes insolvent, enters liquidation or a similar process, or stops trading; or (e) the law, a court or a regulator requires it. We may also suspend the Service, or a login, to deal with a security threat. A suspension lasts only as long as its reason.

11.5 You may end the agreement with immediate effect by notice if we materially breach it and do not put the breach right within 30 days of your notice. We will then refund any fees paid for the period after it ends.

11.6 When the agreement ends, messages to Customers and online check-in stop. For 30 days afterwards, Users can still sign in and download all the Garage's data (Settings → Your data); we email the owner a week before that period ends. We then delete all the Garage's data, which leaves our backups within a further 30 days, except billing records and anything else that the law requires us to keep.

11.7 Sections 7 (for fees owed), 8, 9, 10, 11.6, 12, 13, 14 and 19 continue after the agreement ends.

12. Warranties

12.1 We will provide the Service with reasonable skill and care, and in line with the DPA.

12.2 Apart from that, the Service is provided as it is and as available. To the extent the law allows, we exclude all other warranties, conditions and terms, whether express or implied, including as to satisfactory quality, fitness for a particular purpose, and uninterrupted or error-free operation. We do not promise any particular result, such as a number of reviews or of returning Customers.

12.3 You confirm that you are authorised to enter into the agreement for the Garage, that the information you give us is accurate, and that the Garage will use the Service lawfully.

13. Liability

13.1 Nothing in the agreement limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for wilful misconduct or gross negligence, or for anything else that the law does not allow to be limited or excluded. Nor does anything in it limit the Garage's obligation to pay fees, or its liability under section 14.

13.2 Neither party is liable to the other, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for: loss of profits, revenue, business, contracts, customers or goodwill; loss of anticipated savings; or any indirect or consequential loss, even if it was foreseeable.

13.3 We are not liable for loss caused by: an SMS provider or mobile network not delivering, or delaying, a message; information entered by the Garage or its Users, such as a wrong number or wrong opening hours; your breach of the agreement; or a suspension made in line with these Terms.

13.4 If Garage Content or Customer Data is lost or damaged, your remedy is for us to restore it from our most recent backup, unless the loss was caused by our breach of the security obligations in the DPA.

13.5 Our total liability arising out of or in connection with the agreement, including the DPA, for all claims in any 12-month period, is limited to the greater of: (a) the fees the Garage paid for the Service in the 12 months before the event giving rise to the claim; and (b) €100. This applies to every kind of claim, to the extent the law allows.

14. Indemnity

14.1 The Garage will indemnify us against all claims, losses, damages, costs (including reasonable legal fees) and, to the extent the law allows, fines and penalties arising from a claim or action by a Customer, a regulator or any other third party, to the extent that it results from: (a) the Garage's breach of section 5 or 6; (b) the Garage's breach of data-protection or electronic-communications law as controller; or (c) Garage Content.

14.2 We will tell the Garage promptly about any such claim, let it conduct the defence at its own cost with our reasonable cooperation, and not settle the claim without the Garage's agreement, which it will not unreasonably withhold.

15. Events beyond our control

15.1 Neither party is liable for a delay or failure to perform caused by events beyond its reasonable control, such as failures of mobile networks, SMS providers, hosting providers, the internet or the power supply; fire, flood, earthquake or other natural events; war, terrorism or civil unrest; a cyber-attack despite reasonable security; an epidemic; a strike; or an act of government. This does not excuse paying fees.

15.2 If such an event prevents the Service from working for more than 30 days in a row, either party may end the agreement by notice, and we will refund any fees paid for the period after it ends.

16. Changes to these Terms

16.1 We may change these Terms. We will tell the Garage, by email or in the app, at least 30 days before a change that materially disadvantages it takes effect. If you do not agree, you may cancel before it takes effect, and we will refund any fees paid for the period after cancellation.

16.2 Other changes, and changes required by law or needed for security, may take effect sooner.

16.3 We will show the new version in the app to be accepted. Continuing to use the Service after a change takes effect also accepts it.

17. Notices

17.1 We send notices to the Garage by email, to the owner's email address or to that of the User who accepted these Terms, or in the app. You send notices to us by email to [email protected], or by post to the address in section 1.1.

17.2 A notice by email is received on the business day after it is sent, unless the sender is told that it was not delivered.

18. Transfer

18.1 We may transfer the agreement, including the DPA, to a company that we control or to anyone who takes over the Service, by notice to the Garage. The transfer does not reduce the Garage's rights under the agreement. If you object, you may cancel within 30 days of our notice, and we will refund any fees paid for the period after cancellation.

18.2 The Garage may transfer the agreement only with our written agreement, for example to the buyer of its business. We will not refuse without good reason.

19. General

19.1 The agreement is the whole agreement between the parties about the Service, and replaces anything discussed before it. Neither party has relied on any statement that is not in it; this does not limit liability for fraud.

19.2 If a court finds any part of the agreement invalid, the rest stays in force, and the invalid part applies with the smallest change that makes it valid.

19.3 A delay or failure to enforce a right is not a waiver of it.

19.4 The agreement does not create a partnership, employment or agency between the parties. Nobody other than the Garage and us, including Customers, has any right under it.

19.5 Accepting in the app is agreement in writing and a signature. Our records of acceptances, messages sent and payments are evidence of them unless shown to be wrong.

19.6 These Terms are written in English. If we provide a translation, the English version prevails.

19.7 The agreement, and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims), is governed by the law of the Republic of Cyprus, and the courts of Limassol, Cyprus, have exclusive jurisdiction. Before going to court, a party tells the other about the dispute in writing, and both try in good faith to settle it within 30 days; this does not prevent either party from seeking urgent relief.

20. Contact

For questions about these Terms, the Service or billing, write to [email protected]. Customers with a question about their data can also contact the garage that checked their car in.
